Terms of Service — Absolute DB

1. Software Licence

Absolute DB is licensed under the Business Source License 1.1 (BSL-1.1).

Under BSL-1.1, the following apply:

Source code is publicly available and readable by anyone.
Non-production use — including development, testing, and evaluation — is permitted for all users at no cost.
Production use is governed by the Edition tier conditions described in section 2 below.
After a specified change date, the licence automatically converts to Apache License 2.0, making the software fully open source.

The full licence text is included in the LICENSE file distributed with every release of the software and is available at absolutedb.com.

2. Edition Tiers

Four editions govern production use of Absolute DB. Contact licensing@absolutedb.com with any edition questions.

Community

Personal projects, non-commercial use, businesses with revenue under $100K/year.

SME

$0/month

Businesses with annual revenue under $1M/year.

Professional

$49/mo per server

Commercial production use, unlimited data, unlimited connections.

Enterprise

$499/mo per cluster

High-availability clusters, advanced compliance, dedicated support SLA.

3. Acceptable Use

You may not use Absolute DB to:

Build products that compete directly with Absolute DB without an OEM licence from SupportCALL AU.
Circumvent, disable, or tamper with licence enforcement or key validation mechanisms.
Distribute modified versions of Absolute DB under the "Absolute DB" name or brand without prior written permission.
Use the software in any application or service that violates applicable law.

4. Intellectual Property

Absolute DB and all associated source code, documentation, trademarks, trade dress, and related intellectual property are owned exclusively by D.H. Maree (ABN 21 498 105 915). All rights reserved. The software is licensed to SupportCALL AU as the primary distributor.

The BSL-1.1 licence grants you specific rights to use the software as described in section 1. No ownership interest in the software or its intellectual property is transferred to you by these terms.

5. Disclaimers and Limitation of Liability

The software is provided "as is", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

In no event shall the authors, copyright holders, or distributors be liable for any claim, damages, or other liability — whether in contract, tort, or otherwise — arising from or in connection with the software or the use of the software, beyond the total fees paid for the applicable licence in the twelve (12) months immediately preceding the claim.

This limitation of liability applies to the fullest extent permitted by applicable law.

6. Governing Law

These terms are governed by and construed in accordance with the laws of Australia, without regard to conflict of law provisions. Any dispute arising from or in connection with these terms or the use of Absolute DB is subject to the exclusive jurisdiction of the courts of Australia.
